This webinar explains how a self-managed superannuation fund (SMSF) may acquire an asset using a limited recourse borrowing arrangement (LRBA). We’ll step through the statutory framework that permits borrowing within an SMSF, the trustee obligations when establishing and operating an LRBA, trust structure and documentation considerations, and the practical steps to ensure the acquisition complies with the SIS Act and related regulations.
We’ll also examine the recent change restricting LRBA acquisitions of real property to land that meets the definition of ‘business real property’ in s.66(5) of the SIS Act. The session will unpack what qualifies as business real property, consider common fact patterns and borderline cases, and highlight compliance risks and practical steps for trustees and advisers.

Anthony Cullen

Anthony is a new member of the Accurium education team and comes to us with nearly 25 years of experience in the accounting and SMSF industry.
He has previously held senior roles managing the SMSF division of a small accounting practice and providing SMSF technical support within a large SMSF administration business.
