Many primary production families choose to hold their farmland in an SMSF.
Holding assets in superannuation can provide asset protection and unmatched tax advantages, however with this comes an additional layer of compliance obligations which include the sole purpose test, acquisition rules, arm’s length requirements and the in house asset rules.
We are also receiving an unprecedented level of help desk questions relating to primary producers wishing to diversify the income sources from their land. These include supplementing traditional primary production income with activities like Air BnB, farm stay, cellar doors, solar panels and wind turbines.

What we cover
On completion, participants will be able to:
- Understand the business real property (BRP) definition and how it relates to primary production, dwellings and other activities on the land,
- Articulate the arm’s length requirements to SMSF trustees that lease land to related parties,
- Understand what needs to be considered when repairs, maintenance and improvements are required and who should provide the funding.
- Hold preliminary succession planning discussions with clients before directing them to legal professionals

Our presenter
Jason Hurst
Jason is an experienced commentator, presenter and writer on superannuation and retirement. He specialises in breaking down complex technical concepts for professional advisors and their clients.
He has over 20 years’ experience in the wealth and retirement sectors, working with accountants and advisers to build their technical skills in superannuation, retirement, Insurance, social security and age care, and enjoys helping to provide the tools to articulate these concepts in a simple and easy to follow way to clients.
Jason also works with the Financial Advice Association Australia (FAAA) as a subject matter expert for the CFP 5 program and a technical student mentor to those undertaking the CFP courses.
He has a Bachelor of Economics from the University of Newcastle, is a SMSF Specialist Advisor, and holds the Certified Financial Planner (CFP) designation.
