A Live Instructor Led 6-Part Web Series

The six-part SMSF Evolution Web Series provides an essential walk-through of how to work with clients throughout the lifecycle of an SMSF. Using a single case study, we explore the investment decisions, and the issues and decision points when life happens along the way.

Our case study family will have the complexities of Home & Away;  we’ll explore their investment decisions for property development, the issues that arise when things don’t go to plan, and the investment objective that evolves over time. We’ll also highlight the ‘red flags’ and demonstrate how to keep the fund compliant.

In the pragmatic web series, we’ll work through:

  • the process of establishing the right structure
  • involvement of related parties
  • a property development
  • divorce
  • disagreements and incapacity, and finally;
  • assessing access to the small business CGT concessions

What we cover

The SMSF Evolution Web Series uses a single case study to demonstrate how SMSFs develop and evolve over time. We walk through a related company that undertakes a property development utilising the SMSF balances of some of the directors. We also explore the issues that need to be addressed to ensure that the non-arm's length income rules will not apply to the development.  

Then we walk through what happens to the SMSF when disagreements or divorce emerge and what advisers can do to keep the SMSF running smoothly. Plus, what happens when capacity issues come to the fore and the adviser’s role in that process.

Finally, we cover off the small business CGT concessions and how they might apply. Phew!

Session 1: SMSF Structuring

April 17, 2023

The process to identify the best structure for your client’s scenario. Using our case study, we identify the structure for the family group to fulfil their property development ambitions for the fund.

  • We methodically work through the options to identify what will and won’t work for the family group, highlighting the advantages and disadvantages of the options
  • Working with the Part 8 associates rules, acquisitions from related parties and why in-house assets are not always a dirty word

Session 3: SMSFs & Property Development

Property development is one of the most common catalysts for SMSF set up. It is also the most common compliance problem area. Working with our case study, we look at the complexities of property ownership and development in an SMSF and how to get it right.

Session 5: Incapacity Issues & Retirement

Retirement can be a trigger to review an SMSF’s investments and brings into play pension strategies for retired members. Trustees often consider succession planning but fail to consider the possibility of a member/trustee losing capacity.

  • We consider the liquidity requirements of an SMSF. Liquidity is a requirement of the investment strategy and becomes even more important in retirement
  • What happens if an SMSF can’t or doesn’t make a minimum pension payment?
  • Appointing attorneys as trustees/directors and understanding where it can go wrong

The small business CGT concessions offer a way for some or all of the capital gain made from the sale of business assets to be exempt from CGT if certain conditions can be satisfied. We look at the concessions that specifically interact with the superannuation system and the process required to wind-up and roll over to a new fund.

She has led the SMSF divisions of mid and second tier firms and understands SMSFs from the ground up – accounting, tax, structuring and advice. At Knowledge Shop, Natalie is an advisers’ adviser, helping the profession clarify the practical requirements and opportunities of SMSFs. She brings this knowledge to her presentations and explores the issues in a very practical way – knowledge that is immediately transferable in practice.

Natalie is a Chartered Accountant and a specialist member of the SMSF Association.

Michael CarruthersMichael is an adviser, author, in demand presenter, mentor to Knowledge Shop’s technical team, and is well known for his capacity to translate highly technical information into tangible and useable advice for the profession. Jason HurstJason is an experienced commentator, presenter and writer on superannuation and retirement. He specialises in breaking down complex technical concepts for professional advisors and their clients.

He has over 20 years’ experience in the wealth and retirement sectors, working with accountants and advisers to build their technical skills in superannuation, retirement, Insurance, social security and age care, and enjoys helping to provide the tools to articulate these concepts in a simple and easy to follow way to clients.

Jason also works with the Financial Planning Association (FPA) as a subject matter expert for the CFP 5 program and a technical student mentor to those undertaking the CFP courses.

He has a Bachelor of Economics from the University of Newcastle and holds the Certified Financial Planner (CFP) designation.
